Terms and Conditions
This constitutes a service agreement between CUSTOMER and Designing Web for the purpose of providing CUSTOMER with an electronic address on the global network of computers known hereafter by the network's popular
name: "Internet". Designing Web reserves the right to cancel any newly established account within the first 30 days of the account's creation. Accounts canceled within the first 30 days will receive a full refund, including setup fees charged by Designing Web. PAYMENTThe CUSTOMER agrees to pay Designing Web a monthly Service Fee as outlined on the as outlined on the “Web Site Pricing Page” (http://designingweb.net/hosting/plans.htm). For succeeding monthly periods, Designing Web will bill CUSTOMER for storage with payment due and owed no later than 20 days following receipt of the bill. In the event of two late payments, consecutive or not, CUSTOMER agrees that Designing Web has the right to delete all data, files or other information that is stored in the Account after CUSTOMER receives oral, email or written notification thereof. Additionally, CUSTOMER agrees to pay all costs associated with the collection of the balance owed, including all reasonable attorney fees and court costs.The above mentioned fees entitle the CUSTOMER to a “Designing Web Hosting Package” as outlined on the “Web Site Pricing Page” (http://designingweb.net/hosting/plans.htm). Note: Please note that the planes are subject to change and it is the Customer's responsibility to regularly check for modifications. USAGE POLICIESCUSTOMER agrees to use the Designing Web account in a way that conforms with all applicable laws and regulations.The CUSTOMER shall not engage in any conduct which in the sole discretion of Designing Web, restricts or inhibits any other user, whether a user of the services or a user of any other system, from using and enjoying the Services, or other Internet Service. This includes, but is not limited to posting or transmitting any unlawful, threatening, abusive, libelous, defamatory, obscene, offensive, indecent, pornographic, profane, or otherwise objectionable information of any kind, including without limitation any transmissions constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, federal or international law, including without limitation the U.S. export control laws and regulations, and laws protecting intellectual property including copyright, trademark, trade secret, misappropriation and anti-dilution laws. You agree that the subject matter you display can be restricted at any time and for any reason, and must then be removed from public display. Designing Web is not responsible for files and data residing on the CUSTOMER'S account. SPAM EMAIL - We do NOT allow our servers or resources to be used in any way to facilitate the sending or sending of Spam mail (unsolicited commercial email) You agree that Designing Web reserves the right to refuse hosting services to any site whose purpose is to engage in the distribution of "Adult Oriented material." CUSTOMER specifically agrees not to make any attempt to gain unauthorized access to any systems or networks contained either within or outside or under the direct control of Designing Web. Designing Web may use the company name and/or company URL of any Designing Web CUSTOMER for the purposes of marketing. NO WARRANTYCUSTOMER understands that the Internet and other various networking communication mediums are not secure, unless explicitly specified as such, and may be subject to interception or loss.The Services are provided on an "as is" basis. Designing Web MAKES NO WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OR TITLE, USABILITY, CONDITION, NON-INFRINGEMENT, COMPATIBILITY, SECURITY, OR ACCURACY AND EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. INDEMNIFICATIONCUSTOMER agrees not to hold Designing Web responsible for any losses suffered as a result of using our services, including but not limited to loss resulting from service delays and incomplete or interrupted service, regardless of cause.The CUSTOMER agrees to indemnify and hold harmless Designing Web in any legal action caused by or resulting indirectly from the use of our services, without limitation or exception. This indemnification and hold harmless agreement extends to all issues associated with your account, including but not limited to domain name selection and Web site content. TERMINATIONThe CUSTOMER may terminate this Agreement upon written notice, 60 days prior to the Payment Date as set forth in Payment Section, to Designing Web's address. Upon CUSTOMER's termination, Designing Web shall not refund any prepaid fees. The CUSTOMER also agrees that Designing Web has the right to delete all data, files or other information that is stored in the Account if this Agreement is terminated. The No Warranty and Indemnification Sections shall survive termination of this Agreement for a period of two (2) years.CUSTOMER understands that Designing Web reserves the right to terminate the account at any time for failure to abide by the terms of this agreement or failure to pay any fees or charges when due. The failure of Designing Web to insist upon or enforce strict performance of the CUSTOMER of any provision of this agreement shall not be construed as a waiver of any provision or right The terms of this agreement may only be changed in writing and any changes must be signed by both Designing Web and CUSTOMER to be effective.
